  Problem: my realtor wants me to sign a "buyer agency" agreement -what is that and should I sign one?

Solution: Yes

In the "olden" days you would call a Realtor who would help you but owed you no fiduciary duties. They were paid by the Seller and in law owed them a duty of care. This was a problem because consumers felt (correctly) that the Realtor they were using was "their" Realtor who really should keep their interests in mind. What happened was that the Realtor might know something bad about the home you were interested in, but did not necessarily have to tell you about it, because their loyalties were to who paid them -the seller.

Because of this "Buyer Agency" was developed. When you hire a Buyer Agent they have to look after you and owe you a duty of care. The contract they want you to sign essentially says that and adds that you agree to work with a particular agent for a particular period of time. BE CAREFUL!! This is a contract you are signing and if you breach its terms (by going to another realtor within the time frame of the contract) you could be held responsible for damages to the Realtor.
