What is a Power of Attorney?
A will only takes effect on death. If you are incapacitated a Power of Attorney is a legal document that gives another person the authority to make decisions for you if you are unable to make them for yourself.

There are 2 types:

1. A Continuing Power of Attorney gives someone else the authority to make decisions about your finances. If you become incapacitated without having chosen an attorney (that person does not have to be a lawyer), the Public Guardian and Trustee will appoint a "Guardian of Property".

2. A Power of Attorney for Personal Care gives another person the authority to make personal care decisions on their behalf if they become mentally incapable. In you become incapacitated without choosing an attorney, a Court may appoint a "guardian of the person".

If you have a will drafted by Korman Associates, we will also discuss and prepare both Powers of Attorney with you free of charge or you may wish to download the government's Powers of Attorney booklet and forms to complete on your own.
